The sale of Terre di Perseto’s selections and all products related to the world of wine, oil and spirits offered in the on-line shop, hereinafter named TERRE DI PERSETO (with reference to the domain TERREDIPERSETO.COM here after "Site"), are governed by these General Conditions of Sale.

This e-commerce activity is addressed to users who are "consumers" of more than 18 years and in any case it’s according to the law in force and the regulations concerning e-commerce.
For "consumer" TERRE DI PERSETO means any physical person who operates on its website TERRE DI PERSETO with it not related to his professional, commercial or business, possibly carried out.
In compliance with the laws in force concerning the purchase of wines and spirits TERRE DI PERSETO reserves the right not to proceed with orders from subjects other than the "consumer" and in compliance with the age limits set by law for both purchase and for the delivery of spirits, wine and spirits. In particular TERRE DI PERSETO does not sell spirits, wine and spirits to people under 18 and, through the use of the TERREDIPERSETO.COM website, you guarantee, on the one hand, that you are over the age of 18 and, on the other on the other side, that the person who will receive the shipment by TERRE DI PERSETO will be over the age of 18.
The General Conditions of Sale exclusively regulate the offer, transmission, acceptance, shipping, purchase methods and right of withdrawal of purchase orders for products on the site TERREDIPERSETO.COM, between users of the Site and the TERRE DI PERSETO company, while they do not regulate the supply of services or the sale of products by different subjects that are present on the Site through hyperlinks, links or banners.
The General Conditions of Sale are periodically modified by TERRE DI PERSETO based on the development of their business and the market, as well as in compliance with any updates and legislative changes. Every update and modification will be regularly published on the Website and immediately effective from the date of publication.

SALES CONTRACT

To purchase one or more products offered on the Site it is necessary to fill up the order form in electronic format and transmit it to TERRE DI PERSETO by e-mail or fax, following the relative instructions.
The order form contains a summary of the main commercial conditions, including the price, the means of payment and the methods of delivery, as well as information on the main characteristics of the product ordered and a reference to the General Sales Conditions.
Once the contract is concluded, TERRE DI PERSETO will process your purchase order.
Before transmitting the purchase order, TERRE DI PERSETO will ask you to correct eventual errors in data entry, to read carefully the General Sales Conditions, including the right of withdrawal, to print a copy and to store or reproduce a copy for Your personal uses.
The contract is in Italian but a translation is available in English (coming soon).
TERRE DI PERSETO may refuse or in any case not proceed with purchase orders that are incomplete or incorrect, or in case of unavailability of products or orders that do not give sufficient guarantees of solvency, providing in such cases to inform you by e-mail that the contract is not concluded and will not be processed to your purchase order, specifying the reasons and possibly suggesting a possible solution.
If any of the presented products on the Site are no longer available or on sale when the order form is sent, TERRE DI PERSETO will promptly notify you and in any case within thirty (30) days, starting from the day following that of the order transmission, the possible unavailability of the ordered products. In the case that you have already submitted the order form and paid the price, TERRE DI PERSETO will provide in first instance to suggest one or more possible alternatives of commercial value equal or superior to the order, that can satisfy it, otherwise it will provide to reimbursement of what you have already anticipated.
By sending the order form via e-mail, you declare that you know and accept unconditionally the TERRE DI PERSETO General Conditions of Sale and undertake to observe them in all relationships with TERRE DI PERSETO. In the event that you do not share and / or do not intend to accept, even partially, the terms set out in the General Conditions of Sale, please do not submit the order form for the purchase.
Transmitting the order form, you also confirm that you know the additional information contained in the Site, including any references via links, as well as the First and Second Sections (Privacy and General Use Conditions).

PRICES

All prices to the public are VAT included and the cost of transport is shown separately on the order form and on the invoice.
Published prices and offers may change its formats during the years, for this reason TERRE DI PERSETO reserves the right to make changes without notice.
In case that a price has been incorrectly published by mistake, TERRE DI PERSETO reserves the right to renounce the sale.
Prices are subject to updates, so we always ask you to check the final sale price before submitting the order form.

PAYMENTS

The payment methods are indicated in the order form.
The purchase of the products is inclusive of the shipping costs (visible separately) and will be debited to your current account at the time of shipment of the purchased products, as indicated in the order form.
The preferred payment method is by credit card, pre-paid card, Pay Pal and bank transfer.
All the financial information necessary for the transaction will be transmitted via encrypted protocol to CHIANTI BANCA, which provides the relative electronic payment services at a distance, without third parties having access to it.
Such information will never be used by TERRE DI PERSETO other than to complete the procedures related to your purchase and to issue the relative reimbursements to your favor in the event of any refunds of the products, as a result of exercising your right of withdrawal, or if you make it necessary to prevent or report to the police the commission of fraud on the site.

SHIPPING AND PRODUCTS DELIVERY

The shipment will always be accounted for with a regular invoice.
TERRE DI PERSETO uses, for deliveries, packaging patented and certified by the best national and international couriers (MBE, DHL, BARTOLINI, GLS, TNT and others), with which it delivers the products ordered to the address indicated in the procedure of purchase and assume full responsibility for delivery by taking over at our company, until delivery to the address indicated by you.
Any damage or mismatch in the number of packages, as well as any delays in delivery, must be immediately notified to the courier making the delivery, with the words "withdrawal with reserve for lack and / or damage of n ° ... packages "on the delivery document and confirmed by e-mail to Terre di Perseto within seven calendar days. Even if the packaging is intact, the goods must be checked within seven calendar days of receipt.
As the Legislative Decree 22/5/1999 n.185 (distance contracts) the goods travel at the risk of the recipient, therefore Terre di Perseto is not responsible for any theft or damage caused by the Italian Post Office or by the couriers used, or by third.

It is important that the customer, upon receipt of the goods, verify that:

the number of packages delivered corresponds to that indicated in the tax document;
the goods correspond to what actually indicated in the tax document;
the packaging is intact, not damaged or wet or otherwise altered or tampered with, also in the materials / sealing seals (adhesive tape, etc.).

For delivery execution are indispensable the following information:

billing information = name and billing address, tax information, e-mail address;
delivery data, ie name and delivery address, telephone number, e-mail address.

RETURN

In case of goods deemed defective, we ask you first to inform us by e-mail at the e-mail address: contact@terrediperseto.com, so you can immediately identify the problem and find a solution together with you.
Defective goods can be returned by you to TERRE DI PERSETO in its original packaging within 15 days from delivery, the shipping and packing costs for the return of the shipment are at your charge while the defective goods will be replaced and sent back to you of TERRE DI PERSETO or reimbursed if exhausted.
In case you decide to use your right of withdrawal, TERRE DI PERSETO has the right to not accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged or partially consumed.
If you receive packages visibly damaged by the courier, broken or stained by the leakage of liquid from any broken bottles, please reject the shipment to the sender and we will take care of the return and restoration of the shipment.
If the shipment were more packages and not all were damaged, please reject the damaged package to the sender by signing the courier "Con Riserva" (= With term) and TERRE DI PERSETO will return the damaged package and replace it.
If the product to be replaced is exhausted, we will contact you directly for a possible replacement or the crediting of the residual value. Any shipping costs for return to the sender of the damaged package and return of the new one are charged to TERRE DI PERSETO.
Delivery typically takes place on weekdays, in two to four working days from the date the order is placed on the Site with payment by credit card, PayPal and prepaid card.
In case of payment by bank transfer, delivery will take place with the same timing, but starting from the date of confirmation of the transfer of funds.

RIGHT OF WITHDRAWAL INFORMATION

According to the regulations of Legislative Decree 206/05, you have the right to withdraw from the contract of purchase of the products, without any penalty, within 10 working days from receipt of goods and prior written notice to be forwarded to TERRE DI PERSETO, using the procedure return management. On the other hand, it is not possible to change the individual bottle of wine, spirits or oils, or the chosen product with another, at no additional cost. Our customer service is always at your disposal to try to resolve any of your requirements concerning your order, so please get in touch with TERRE DI PERSETO by e-mail: contact@terrediperseto.com.

In the communication you must indicate the product or products for which you intend to exercise the right of withdrawal, the order number and the order date, the invoice number, your bank details (IBAN). Once the communication has been made, you will be asked to wait for feedback from our Customer Service authorizing the return.

You can then send the returned goods back to the courier for delivery within ten (10) working days from when you received the products, provided they are intact, in the manner and within the terms agreed, except your possible renunciation of the return of said goods products.
The only expenses that must be incurred are those for returning the products purchased, in accordance with the art. 5, paragraph 6, Legislative Decree n. 185 of 22/05/1999.
The right of Withdrawal, in addition to compliance with the terms and procedures described above, is to be exercised correctly if the following Conditions are fully respected:

the purchased products must be substantially intact;
the products must be returned in their original packaging;
the returned products must be sent in a single shipment and TERRE DI PERSETO reserves the right not to accept bottles or products of the same order, returned and sent at different times;
the cost of return of the goods will be at your expense, including the responsibility in case of loss or damage to the products.
the products arrived in stock will be examined to assess any damage or tampering (the substantial integrity of the returned goods is an essential condition for the exercise of the right of withdrawal). We recommend maximum attention in the preparation of the package
the products must not have been used or damaged.

The right of withdrawal is reserved only for natural persons, previously defined as "consumers", therefore any purchases made by retailers or by entities that for any reason purchase for resale are excluded.
The return form must be correctly completed and sent to TERRE DI PERSETO within ten (10) working days from receipt of the products.
If the Right of Withdrawal is exercised following the procedures and terms indicated TERRE DI PERSETO will refund any sums already collected for products purchased directly from the Site that will be reimbursed as soon as possible and, in any case, within thirty (30) days from the date TERRE DI PERSETO became aware of the exercise of your right of withdrawal.
The refund procedure will be activated once the correct execution of the above terms and conditions has been verified.
If the terms and conditions for exercising the right of withdrawal have not been respected, you will not be entitled to reimbursement of sums already paid to TERRE DI PERSETO or to issue the requested credit.
In any case, it will always be possible to recover the products in the state in which they were returned to TERRE DI PERSETO.
Otherwise, TERRE DI PERSETO may retain the products, in addition to the sums already paid for their purchase.

REFUND TIMES AND METHODS

Once the products have been returned, TERRE DI PERSETO will carry out the necessary checks regarding their conformity, the conditions and terms indicated.
In case that the checks are concluded positively, TERRE DI PERSETO will send you, via e-mail, the relative confirmation of the acceptance of the returned products.
Whatever payment method used by you, the refund is activated by TERRE DI PERSETO in the shortest possible time and in any case within thirty (30) days from the date on which TERRE DI PERSETO became aware of the exercise of your right of withdrawal, after verification of the correct execution of the right of withdrawal and acceptance of returned products.
In case there is no correspondence between the recipient of the products indicated on the order form and who made the payment of the sums due for their purchase, the repayment of the sums, in case of exercise of the right of withdrawal, will be performed by TERRE DI PERSETO, in any case, towards the person who made the payment.

APPLICABLE LAW AND DISPUTE RESOLUTION

The General Sale Conditions are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206, on the consumer code, with specific reference to the legislation on distance contracts and by the legislative decree 9 April 2003 n. 70 on some aspects concerning e-commerce.
